New York District Court Denies Preliminary Injunction in Taser Case
In a rather detailed Opinion, Judge Hurd denied District Attorney Sackett's Motion to Dismiss and Plaintiff's Motion for Preliminary Injunction. Essentially it appears that the Court wanted more data on stun guns and/or Tasers and to develop the record on whether stun guns/Tasers are in "common use" and not "dangerous and unusual." Department of State answers FOIA Complaint in Terry v. DOS
Nothing substantive here. Basically, Department of State acknowledged it received the FOIA request and "admits that is has not issued a final response to Plaintiffs’ June 30, 2016 FOIA request with any determination as to whether it will release the requested records."
